ABSA leaking private banking information to third party. Contravening the POPIA act.
Recently, my car was repossessed by ABSA vehicle finance.They sent out a tracing agent who recovered the car from a friend, and during this process, had a conversation with the third party, and exposed private information to him. This i know is a breach and contravention of the POPIA ACT.ABSA has now come to the defense of the tracing agent, who relays a different story and presents himself as NOT GUILTY. This is what transpired....The car was in the care of a friend. who now and again, used it to commute to work as i am in Cape town. He works in the Umhlanga area. He was seated in the car, at a parking opposite THE GATEWAY HOTEL. The tracing agent and a colleague was parked behind him. The tracing agent knocked on the window of my car and asked the driver if he was RAJAN THOMAS. The driver responded by saying "NO".The tracing agent told the driver that he was from ABSA and was there to recover the vehicle. As would anyone, the driver questioned "why". The tracing agent then told the driver {Third Party} that Mr. Thomas did not pay for the vehicle for the last 11 months. R33000 was owed. The car is now being repossessed and would surely go into auction in the next 14 days if the account is not settled. He also mentioned that if the vehicle was auctioned ,it would sell for less than what is owed and the deficit would have to be paid by myself. Upon hearing this, the driver called me with his personal phone and explained to me what was going on. I asked to speak to the gentleman, and he told me who he was and why he was recovering the vehicle. I did mention to him that the account is being disputed with ABSA CREDIT LIFE AND THE FINANCIAL OMBUDSMAN. To him, this was of no significance, so i asked the driver to allow him to take the vehicle.
Any information between myself, the account and ABSA should not have been relayed to a third party. This is a major contravention of the POPIA act, and a civil liability issue is now being pursued. In his defense, the agent has now conjured up a story, which i believe is predominant in his line of work. 1.He says the car was being used as a UBER vehicle. {I HAVE TRACKER ON THE CAR AND IT WILL SHOW ALL ROUTES OF THE VEHICLE.] 2.He says that the driver told him we had an agreement with vehicle and the driver was paying for the car. (another story taken from his book) I have a sworn affidavit from the driver who insists nothing of the sort was spoken about and all the information had come from the agent. 3.The agent says he called me, and i offered much resistance and was not cooperative. ( i have never once spoken to this agent. I have all my calls logged and i asked that he produce his call log and the day and time when he had spoken to me.} IN CONCLUSION. ABSA and their agent had erred and had broken all laws pertaining to the POPIA act. ABSA has brushed aside my complaints and has come to their agent's defense. ABSA needs to now compensate me for breaching this Privacy Act and i believe that the ombudsman is busy investigation the issue of repossession and will soon inform me of their findings. If the outcome of this complaint is not beneficial to me ,i will have to raise this issue on all social media platform and pursue this matter via the legal system.
We have addressed your concern as per case C-***5 by providing the final position of the bank. We also advised that we would be more than willing to further review the matter if you make an acceptable payment and provide us with your updated proof of address. Failing to provide this, we proceeded with the further recourse process referral to the Ombudsman.

As per ABSA, the issue regarding repossession and Credit life is now with the ombudsman. The issue of contravention of the POPIA ACT has not been addressed. How is ABSA going to resolve this matter. Must this issue be addressed by the legal system. As i understand, in the event of any breach in the POPIA ACT ,the Defendents have no ground to stand on. ABSA is now conveniently raising the issue of the dispute between myself and CREDIT LIFE, but not resolving this issue.
As for the payment arrangement, I offered to have the outstanding balance added to the CAPITAL amount and the instalment raised to R3500.
