ABSA is a Disgraceful Bank

Stay away from ABSA and especially their insurance policies. They will have you pay premiums and when it is their turn to adhere to the policy they have excuses.

The assessors cannot read to understand, they only read one little word and think they have summed up the entire claim. Other banks understand and can actually read properly and they adhere to their policies but ABSA does not.

Neither do they understand Sections 37(4)(a) and 32(3) of the Basic Conditions of Employment Act. Nor can they understand the term Constructive Dismissal. Sending them the information sheet for Constructive Dismissal as per the CCMA and Labour Law also does not understand because they cannot read properly and they do not know what a material breach of contract from the employer means and why a constructive dismissal case is awarded. Go read the sections of the BCEA as per above given and maybe you as ABSA will LEARN something!!!

You can send them all the proof that they are in the wrong and explain until you are all the colors of the rainbow yet they still refuse to pay out claims when infact they cannot understand court orders at all.

ABSA also does not answer complaints for months no matter how many times you ask for feedback. They completely ignore their clients when there is a complaint and venting on social media you get a little bit of feedback yet they are still not understanding what they read and send you a section back in their policy which is not applicable as they do not understand what they are actually reading in the complaint and claim, they ask for additional documents and you produce these yet they still do not understand.

Rather go to a bank that will put in the effort to assist you. You will honestly get better service from a rock than you will ever get from ABSA.

Yet ABSA still declines because they have no idea what they are reading and claim to have a resignation letter as per the BCEA Sections 37(4)(a). I am awaiting this signed and written resignation which ABSA claims to have. And i also want to know how does one enter an office which was boarded shut by rental agents because the employer was not paying the rental monies. You were sent a new letter dated 3 May 2019 from the attorneys to ourselves in regards to this matter.

Further more also look up section 32(3) of the BCEA. The employer already BREACHED CONTRACT with NON PAYMENT OF SALARY even after letters of demand was sent to him he still breached employment by not paying a salary for 2 month straight.

If your supposed resignation was valid the CCMA would not have approved constructive dismissal!!! They approved constructive dismissal solely because the employer did not pay the salary as requested on more than one occasion!

ABSA is not understanding what they are dealing with.

Also according to your email it states resignation 5 April and last day 6 May 2019. So please advise me where this salary is for MARCH and APRIL because it was never paid nor was the LEAVE DAYS paid out. Nor was the Constructive Dismissal Award Paid and neither was the Labour Court Award paid out!

I am awaiting this SIGNED RESIGNATION letter which I did not write nor signed as per section 37(4)(a).

An update!AFTER NUMEROUS COMPLAINTS FOR MONTHS!ABSA IS STILL DECLINING TO PAY OUT!According to them there is a resignation that NEVER took place! According to the BCEA a resignation must be in writing unless the employee is illiterate.ABSA also does not understand what CONSTRUCTIVE DISMISSAL is and that it is not a resignation. ABSA also does not understand that a constructive dismissal case is NOT a very easy case to proof at the CCMA. And they also do not understand that there is no VALID WRITTEN AND SIGNED RESIGNATION which they indirectly claim to have and refuse to GIVE A COPY. WHY? Because this resignation they claim to have does not exist.Also they do not understand that the Leasing Agents closed the property so that no employees could enter the property as it was boarded up.ABSA has been in possession of all needed proof that the employer BREACHED EMPLOYMENT with the employee by not paying the employees salary for more than two months and neither did the employer pay out the salary and leave days due to the employee even when the CCMA Awarded Constructive Dismissal.It is quite interesting how all other financial institutions paid out their policies but ABSA is declining because they DO NOT UNDERSTAND the law! And they use a resignation as an excuse for decline. A resignation that never took place at all.SO ALL BEWARE NEVER TAKE OUT ANY INSURANCE POLICIES WITH ABSA!!! And if you have one rather cancel it nd get insurance from an institutions which is actually worth it and willing to assist. They will make you pay premiums and when it is their turn to pay out they find excuses without valid proof of a so-called resignation.Nor do they understand that the employer has to date made no effort to pay the monies owed even with a CCMA and Labor Court Award and proof that the office of the employer was locked up by the rental agents. Nor do they comment and how the employee was supposed to enter a locked up office and even get to work without his remuneration being paid.
