ABSA IDIRECT INSURANCE
<p>Hello Peter</p> <p>On the 14th of March 2016, I was driving on N2 enroute to St Lucia. It was raining and I was driving on the stretch of road with two lanes, fast and slow lane on my side and with no barriers separating the oncoming side of traffic which had one lane only. There was a stationery ambulance parked on the yellow lane in the side of the road on my right. </p> <p>An oncoming heavy duty truck tried to steer clear of the stationery ambulance and veered onto my lane. on the slow lane was another heavy duty truck and I was stuck between the two trucks which is when I panicked and app**** the brakes, which at the time was the best decision I could make to avoid a head on collision. The momentous decision to brake and the weather conditions which made the roads wet resulted in the car spinning out of control.</p> <p>On the 2nd of March 2016, I did full service of 60 000 KM and I also did a wheel alignment and balancing with Barons VW on this day, this was just 12 days before the accident.</p> <p>Balancing and alignment was done and I was never advised to change tyres and this was not documented on the job card as well as on any kind of documents submitted to me (balancing and alignment invoice attached)</p> <p>I am a qualified Chartered Accountant and my designation and profession demand ethics and integrity as an integral part of my behavior.</p> <p>I was stopped by traffic police during the period and they did check the tyres and no tickets or indication of road unworthy tyres was made to me.</p> <p>Furthermore, the insurance company should have allocated a specialist to go to (e.g. PG GLASS/GLASS FIT to check if the tyres were of good condition or not every after 6 months or so), so to ensure that their customers are driving on road worthy tyres but they did not, thus as default, I re**** on my car specialist which is VW to do this for me and as documented on their job card I had no reason to believe otherwise.</p> <p>I was never negligent, I ensured that the car was serviced on time and checked the tryes regularly. I am an auditor by profession and not a tyre specialist so I did check the car in accordance with the rules I have learned when doing my drivers learners in the K53 book, and as far as I know, the tyres were road worthy and when VW never advised me to change my tyres after the service and wheel alignment & balancing was done, this confirmed my findings.</p> <p>Furthermore page 19 part 7 of the contract reads “What we will not compensate you for: 1. caused by the vehicle not being roadworthy”</p> <p>There is no further description of what roadworthy means or refers to for further clarity to me and I was never advised when entering the contracts what this broad sentence mean or where to go to and read what is considered to be “vehicle not being roadworthy” there is no ground for my claim to be denied on this basis, unless the insurance company concludes that VW is not fit to render the service they do and release cars onto the roads that are not roadworthy, my claim stands.</p> <p>If the insurance still denies my claim, can they consider paying me back all my premiums I have paid them since the inception of the contract as I still owe the bank the money and considering the fact that I was never negligent when it comes to taking care of the vehicle and re**** on the specialist(VW) and to my best ability, I believe the car was roadworthy at the time of the accident.</p> <p> </p> <p>The claim was rejected and I think this was unfair to me as a final consumer who ensured at all times that I was driving in lawful tyres and I feel ****** by the ABSA IDIRECT insurance and would not advise anyone to join it.</p> <p>Thank you</p> <p> </p> <p> </p>
