Car Sales - Worst service ever

<p>A 2007 Mercedes-Benz C-Class C180 Kompressor Avantgarde was advertised on Auto Trader for R109 995.</p> <p>(http://www.autotrader.co.za/used-cars/mercedes-benz/c-class/2007-mercedes-benz-c-class-c180-kompressor-avantgarde--fpa-1fc9ada861c ********** 548606ae7cc5d8)</p> <p>The seller of this vehicle was 4D Autos, Goodwood. My mother (Worcester) indicated to me she is interested in this vehicle. She made contact with the sales agent (Annelene Coetzee) at 4D Auto who communicated with me for inspection and test drive. On 27 August 2016 I took vehicle for test drive and was impressed with the vehicle and sales agent communication s****s (make you feel at ease) to such extend that should buy the vehicle. The vehicle had certain things like scratched bumper and overdue service (indicated on vehicle display) which needed to be done before sale which the sales agent (Annalene Coetzee) agreed to. Annelene Coetzee numerous times requested a cash amount to secure the availability of the vehicle.</p> <p> </p> <p>My mother came to settle the purchase on Hire Purchase (HP) with a 45% deposito. She communicated with an Emile at CMC Lifestyle, (3 Hugo Street, Goodwood) who gathered her details and submit her application for HP. The process had to run its course +/- 2days. They communicated to my mother informing her deal have been approved.</p> <p> To not travel with large sum of money and speed up the process she decides to rather transfer the amount into their account. At this point no contract was signed or agreed upon.</p> <p> </p> <p>Upon confirmation of money transferred Emile (CMC Lifestyle) sends her an invoice stating:</p> <p> -Additional funds of R6895.00have been added as she was charged for the service of the vehicle and for delivery. -She was also charged for Roadworthy and Registration where no communication was done explaining to her what the additional funds were for.</p> <p> -The invoice also indicated a different Class type than advertised.</p> <p> </p> <p>My mother than decided she does not want to continue with the purchase and requested 4D Autos / CMC Lifestyle to repay her funds she deposited. Annelene Coetzee responded they will only pay back a portion of the deposito as my mother is liable for a cancelation fee?</p> <p> </p> <p>To date no arrangement was made for refunded.</p> <p> </p> <p>My Question is if not private sale or buys as is:</p> <p>How the hell can the customer pay for service of the vehicle not yet purchased?</p> <p>How the hell can the customer be liable for Roadworthy and registration?</p> <p>With a National Consumer act in place protecting us as consumers against these so called Sales Agents how is it they still ignore this document?</p> <p> </p>
