Violation of my rights as a customer

The company was suppose to refund me R750,but they insist on paying me R600,this happened because the company initially declined my claim until the matter escalated to the ombudsman and there after they decided to approve the claim on the 03.06.15 which was a month later after they decline my claim. I was in contact with Zandile Mkhize a claim administrator. She sent me form that I must fill for a refund, but the problem on that form was that they charged me an access fee of R150.I told her on the email that I will not sign that form unless they refund me an amount of R750,which I spent to fix my phone.They did not fix my phone, so I don't understand why must I pay an access fee OR is there a clause on their policy again [which they claim they sent it to me 5 months later after applying for the insurance] that allow them to rob me ? who said I need a donation of r600 ?...All I want is my full refund of R750 I don't want their r600 donation. They must take back their r600 donation they have deposited on my bank account this morning without my concern.

As per our previous correspondence please be advised that an excess fee is always required in the event of an approved claim.

Should the handset have been repaired by the underwriters repair center at a cost of R750. The underwriter would require the R150 excess from you before a payment to the repair center was made. The underwriter has collected the R150 required excess and has refund you for the repairs.

For every claim you will be required to pay an excess fee. In most cases the handset would have been repaired by the underwriters repairer however as your claim was initially declined this did not occur. The underwriter is bound by the terms of the policy whereby excess must be collected on behalf of the insurer.
The only way the R750 would be refunded was in the event that R150 had been paid in, as it was not paid in, it was deducted from the R750 to be refunded.

This is standard insurance process and the R600 placed into your account is the full refund due to you.

You are welcome to take this matter up with the ombudsman once again should you feel unfairly treated.
