10 Sept 2015, 09:24Hello Sphephelo99,
Thank you for bringing the above to our attention.
We do understand that you would like a Iphone 6. However the policy has always operated in a way whereby we are required to leave client's in the same position as before the claim occurred, not a better or worse position, this is the reason that replacements are done on a bases of like for like.
The policy wording states the following:
In the event that the MOBILE DEVICE
ii) Is replaced by your Insurer, they agree to replace the MOBILE DEVICE with
the same make and model as the Insured MOBILE DEVICE unless the same
make and/or model is no longer available. The Insurer will then replace
with a MOBILE DEVICE of the same value and similar functions as the
original MOBILE DEVICE at the time of loss.
The underwriter is bound by the terms of the policy. The Samsung Note 3 that you had is no longer available and the closest handset to the one that you had would be the Note 4. This is why the underwriters have advised that you will be replaced with this handset.
Please let me know should you require any further clarification on the above matter.
Kind Regards,
Pauline Goosen
