replacement of cell phone

Good Afternoon,
I purchased a new Nokia phone 5330 on July 14th 2011, last week on about 18th Jan 2012 I lost the incoming sound on it. It has not been dropped or wet.
I took it to Vodacom repairs on Friday 2012012 and have been told 3 weeks to get it back, But my point is surely that as a 6 months old phone it shoud be , no questions asked and replaced.We phoned on this following number 086 11266542 to make inquiries about this and was told Bad luck it is getting fixed. This phone is a slider, I had anothe Nokia Slider which after a lot of thought had done the same thing, If there is a problem with this type of phone should it not be withdrawn or something,Unfortunatly when I got the 5330 Nokia , I had had another phone in between that had been stolen so had forgotten that I had the same problem. I am quite prepared to pay the diffrence between a new replacement and the faulty phone but as I said Bad Luck, Tough,
I cannot say I had bad service from the service dept but from Nokia itself I can not reccommend the attitude of take it or leave it, Nice to be so confident about your Company that the customer has no rights.

Kindly be advised that the device warranty agreement states the following:
- The warranty from date of purchase lies with the relevant handset manufacturers for the duration of the implied warranty period, between 12 and 24 months, dependant on manufacturer.
- An "Out-of-Box Failure" (OBF) is defined as a new handset / data card / modem that is found to be technically faulty within 7 (seven) days of purchase.
- The OBF requirements are defined by the applicable manufacturers. Vodacom will operate in accordance with such requirements and specifications for devices originally purchased through the Vodacom Service Provider warehouse.
- Should a device not meet the OBF criteria and is in the range of devices that Vodacom Repairs are authorised to repair, the standard repair process will apply in terms of resolving the reported fault.

I have also responded to you via email in order to address your concerns.
