Outsurance insurance not abiding by contract

I was involved in a motor vehicle accident on the 15 Dec 2011. The damages to my vehicle totalled to /- R47 000,which came about after Outsurance's towing company or storage facility further damaged my vehicle. Outsurance then repaired the extra damages caused after I had to provide them with photographs of what my vehicle looked like at the accident scene and at the first storage facility. That alone totalled to /- R15 000. My vehicle is currently insured for R44 600 and their latest assessment report totals to /-R31 000 and they still dont want to repair the damages claiming that it is UNECONOMICAL TO REPAIR! After reading the contract, I found that it states they will not repair the vehicle if the total amount is more than the insured amount of the vehicle. Looking at the totals it is way under the insured value of the vehicle. The 5 different assessment reports differ everytime they e-mail me an updated copy of it. They claim numbers are not mine. Looking at the tyres stated on the report...its not what I have fitted on the vehicle either. If this is what is stated in their clauses why dont they repair my vehicle? How long am I still going to be without my vehicle?

Hello faeezh,

We fully understand your frustration and apologise for the inconvenience you have experienced up to now.

Our claims manager, Cardo has provided you with regular updates and also assured you the damages to the vehicle purely resultant of the initial vehicle accident were so severe that we deemed the vehicle a write-off.

We are trying to set up a meeting to resolve the matter between yourselves and our assessor, but you only want to have such a meeting to take over a weekend, which our assessor cannot abide by. We await your response hereto and in the interim assure of our commitment to resolve the matter for you.

Regards
Dinky
