I took out a contract with MTN for an iPhone 4s on the 4th of January 2012 at R499 per month.I had previously been on vodacom for the past decade so i ported to MTN to retain my no.I used the phone for 4 days and during those 4days i encountered a number of problems with MTN and i was very unhappy. I went back to the MTN store on the 9th of January 2012,I was told i should just take the phone and leave the store since i had signed for it and that i could not cancel.I asked about the cooling off period and there was no respnse.Suddenly,I was told that in order to cancel my contract i needed to pay R10,000(no reasoning was given for this).I argued my case and stated the existence of the Consumer Protection Act,to which they said they had no idea what it was.About 3 and a half hours later(still at the store),the Manager,Vivian attended to me and said there is nothing she can do.She then told me that the cancellation fee was now R8,000. The phone is currently at the MTN shop and my argument is that in terms of the CPA I have to be charged a reasonable fee for cancellation and do I not have a right to cooling off period? |
