Expansys failing to supply and refusing to re-fund

I phoned eXpansys beginning Feb 2010 to check if stock was available before purchase. On 10 Feb 2010 I placed an order and paid in full. I was promised a 14 day delivery time. 7 days later I was told that the delivery time had been extended by another 15 days. Despite numerous emails requesting them to supply they kept giving me one excuse after the other - always blaming their external supplier. I patiently waited for an Item I really wanted but to no avail.

It is now ONE YEAR later and I have now been informed that because I ( as the client ) have not followed up for a long time the issue has now expired and they have used my funds to defray expenses!!! I paid up front and they never supplied the goods - they therefore did not have any expenses to defray and also made interest on my funds.

I acted in good faith by paying up front - seems to me like a daylight robbery scheme masking as a genuine supplier.

Please note, it is company policy whereby a customer has not replied to any request for info for a period of 6 months or more to write off the funds to defray expenses.

Your order has been refunded in good faith. Please take advice that you need to respond to queries and not leave a matter outstanding for more than 12 months.

Not Impressed: eXpansys have refunded. I maintain that eXpansys should AUTOMATICALLY send a re-fund when they can't supply. Their 'policy' of making it the Client's responciblity to follow up and keeping the money if the client does not, is in my view dishonest
